In accordance with Section 33, Federal Data Security Law (§ 33 BDSG), SCHMALZ+SCHÖN AIR & SEA GmbH points out that personally related data are stored in the course of carrying out this contract.   We are entitled to process and use the inventory data of our customers to the extent necessary to advise the customer, implement the contract and adapt our services in accordance with requirements. Upon request, the customer will be fully informed, free of charge and at any time, of the stored data inasmuch as it relates to him. The acquisition, processing and use of personally related data is performed exclusively in accordance with the valid data protection regulations. A disclosure of the personally related data to third persons shall not take place. This agreement constitutes assent within the meaning of the Data Protection Law.

We operate exclusively in accordance with the Allgemeine Deutsche Spediteurbedingungen 2017 – ADSp 2017 – (German Freight Forwarders´ General Terms and Conditions 2017) and – if they do not apply for performing logistics services – with the Logistic-AGB (General Terms and Conditions of Logistics-Services Providers), as of March 2006, court of jurisdiction is Waiblingen.   Note: In clause 23 the ADSp 2017 deviates from the statutory liability limitation in section 431 German Commercial Code (HGB) by limiting the liability for multimodal transportation with the involvement of sea carriage and an unknown damage location to 2 SDR/kg and, for the rest, the customary liability limitation of 8,33 SDR/kg additionally to Euro 1,25 million per damage claim and Euro 2,5 million per damage event, but not less than 2 SDR/kg.
